INFORMATION RIGHT OF WITHDRAWAL AND RETURN
Without prejudice to what is otherwise expressly provided for in the following paragraph and in the cases referred to in art. 59, first paragraph, of Legislative Decree no. 206/2005 (Consumer Code), the Customer has the right to withdraw from the contract, without indicating the reasons, within 14 days of receipt of the product in person, by a third party in charge or by another recipient; in case of the purchase of several products that are part of a single order, but delivered separately, this aforementioned period starts from the date of receipt of the last product.
Paragraph
To exercise the right of withdrawal, the Customer is invited to contact the dedicated assistance at the email address info@diamantiegioielli.it, and to submit a formal request by registered letter with return receipt or via pec to the address diamantiegioielli@pec.it
After exercising the withdrawal, the payments made by the Customer will be refunded, with the exception of delivery and additional costs, using the same means of payment used for the initial transaction, unless a different means of payment is agreed, remaining the responsibility of the Customer any additional costs, within 14 days of the positive outcome of the checks that may be necessary on the good as better specified below.
The refund may be suspended until receipt of the product and until our commissioned experts demonstrate that the returned goods have been delivered intact and in accordance with the following conditions:
a. The product and its packaging must be in the same condition in which they were received.
B. In case of certification, this must be intact and in perfect condition, the seal must be intact, must not be tampered with or removed. Unsealed products will not be refunded.
c. the product must be returned with all its accessories, any manual and all other documents, with the protective materials in order and the labels and stickers attached to the products.
d. The shopping bag must be returned in the same condition in which it was received.
The Customer, or another third party appointed by him, must keep proof of the shipment of the returned product, being in any case required to document the return. Diamanti e Gioielli declines all responsibility in the absence of such proof.
In case of non-compliance with the aforementioned conditions, Diamanti e Gioielli reserves the right to withhold the corresponding value from the refund granted to the Customer, or to refuse the withdrawal by returning the good to the Customer.
EXCLUSION OF THE RIGHT OF WITHDRAWAL
Pursuant to art. 59, first paragraph, letter c), Legislative Decree no. 206/2005 (Consumer Code), the right of withdrawal is excluded in the case of “custom-made or clearly personalised products”.
Personalised goods are those processed products following “the consumer’s instructions” (art. 45 , Legislative Decree no. 206/2005), not prefabricated but produced according to an individual choice or decision. (HANDMADE Jewellery, ESPECIALLY FOR YOU).
This information is valid as a communication to the consumer pursuant to art. 49, first paragraph, letter m), Legislative Decree no. 206/2005 (Consumer Code).
However, Diamanti e Gioielli is available to evaluate any different return solutions in the event of a desire to return the personalised product.
RETURNED FOR DEFECT OR NON-COMPONITY
In the event that the jewel received does not correspond to what was purchased, in the case of error or damage, the deadline for reporting to the seller is 8 days from the discovery of the defect.
The return procedure must take place in the manner described in the previous paragraphs, but the Customer must necessarily indicate the reason for the return, documenting the differences or defects found with images to be attached to the request.
